1. Scope and acceptance
These Terms govern use of the GuacAI website at www.guacai.dev. By using the site, you agree to these Terms to the extent permitted by applicable law. If you do not agree, please discontinue use. Questions can be sent to code@guacai.dev.
2. Website information and engagements
This site describes our studio, portfolio, and capabilities. It is informational and is not a binding offer, guarantee of results, or professional advice. Submitting an inquiry does not create a client relationship or require either party to proceed. Project scope, deliverables, fees, payment, schedules, confidentiality, intellectual property, support, and data processing will be defined in a separate written agreement. That agreement controls for the relevant engagement if it conflicts with these Terms.
3. Acceptable use
Use the site lawfully. Do not attempt unauthorized access, introduce malware, interfere with availability or security, send spam or unlawful material, impersonate another person, or infringe others’ rights. You are responsible for the accuracy of information you submit and for having permission to share it.
4. Inquiries and confidential information
We may use your inquiry to evaluate and respond to your request as explained in our Privacy Policy. Do not submit credentials, sensitive personal information, or confidential materials through the public contact form. An inquiry alone does not establish a nondisclosure agreement. Confidential project exchanges should be arranged separately.
5. Intellectual property and portfolio
GuacAI’s original website content, design, and branding are owned by GuacAI or used with permission. You may view and use the site for its intended informational purpose; other reproduction or commercial use requires permission unless allowed by law. Third-party names, logos, screenshots, and trademarks belong to their respective owners. References to tools, clients, or platforms do not by themselves imply endorsement, certification, or partnership. Portfolio entries may include client work and product explorations as described on the site.
6. Third-party services and AI outputs
Links and services such as FormSubmit and the tools described on this site are provided by third parties under their own terms. Their availability and behavior may change. AI-generated code, media, and other outputs can contain errors and require appropriate review, testing, and rights clearance before use. Any commitments for a commissioned workflow or deliverable are set out in the applicable project agreement.
7. Availability and disclaimers
To the extent permitted by law, the website is provided “as is” and “as available,” without warranties of accuracy, uninterrupted availability, fitness for a particular purpose, or non-infringement. We may update, suspend, or discontinue parts of the site. Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.
8. Limitation of liability
To the extent permitted by applicable law, GuacAI is not liable for indirect, incidental, special, or consequential losses, including lost profits or data, arising from use of or inability to use this informational website. Nothing in these Terms limits liability that cannot lawfully be limited, including for fraud or other non-excludable conduct. Liability for paid services is addressed in the applicable written agreement.
9. Disputes and mandatory rights
If a concern arises, contact code@guacai.dev so we can try to resolve it. Applicable law determines governing law and jurisdiction unless a separate valid agreement provides otherwise. These Terms do not waive mandatory consumer protections or other non-waivable statutory rights.
10. Changes, severability, and contact
We may revise these Terms by posting an updated version and revision date. Changes apply prospectively, subject to applicable law. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Contact code@guacai.dev for website, service, or legal inquiries.
